When the council made its decisions, it accepted some recommendations identified by the Independent Hearings Panel as being beyond the scope of submissions (‘out of scope’). These included recommendations on the zoning of certain land.

Anyone unduly prejudiced by the council's acceptance of these out of scope recommendations has a right of appeal to the Environment Court under section 156(3) of the Local Government (Auckland Transitional Provisions) Act 2010.
