Separate a building consent

​Why separate your consent

You may want to separate an issued building consent to break the proposed work down into smaller, more manageable sections.

For example, when only some of the work is completed and you need to apply for a Code Compliance Certificate (CCC) for the work that has been done.

When to apply for building consent separation

You can apply for a separation any time after the building consent is issued, as long as the consent is still valid.

You must intend on doing all of the work across the consent you are applying to separate.

If you want to change the scope of the work, Apply for an amendment (major variation).

If there is a structural dependency between units you want to separate, you will need to book a pre-application meeting before you apply.

What is not covered by a separation?

There are several adjustments to consents which are not covered by the separation process, including:

  • removing work on a consent that is not going to be completed
  • making design changes, like including a second bedroom or bathroom
  • adding new work
  • work that has already obtained a CCC
  • staged consents.

Apply for an amendment (major variation) if you want to remove or add work and make design changes.

Before you apply

Email BCSeparations@aucklandcouncil.govt.nz for guidance and a copy of the relevant form.

Upload the completed forms with your application and include:

  • a set of drawings detailing the removal of the work you want to separate.
  • the value of works to be removed
  • the value of works remaining on the consent
  • updated plans that show what work will exist on the new consent
  • structural plans
  • Letter of Authority (if you are not the registered property owner)
  • Record of Title.

You do not need to attach additional documents from the original consent to this application. These documents will be be copied to the new consent(s).

You should know

Make sure you give us specific details on what you would like separated as this information will appear on future legal documents, such as a Land Information Memorandum (LIM).

Processing timeframe

We will process applications to separate a building consent within 20 working days.

Cost of separating your building consent

We charge base fees for the separation amendment and any new applications resulting from the separation.

If we approve the separation of your consent, we will reconcile any charges to date against the inspection base fee that we initially charged on the original building consent.

We charge an inspection base fee to both the original and new consents.

We will invoice you for each newly separated building consent after we have reviewed the application.
